Terms and Conditions of Use

ACCEPTANCE OF TERMS
By accessing and using the website and services of Digital Edge IT, a division of Top Tier Company Limited (“we”, “us”, “our”, or “the Company”), you agree to be bound by these Terms and Conditions of Use (“Terms”). If you do not agree to these Terms, please do not use our website or services.
CHANGES TO TERMS
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
USE OF OUR SERVICES
- You agree to use our services only for lawful purposes and in accordance with these Terms.
- You must not use our services in any way that could damage, disable, overburden, or impair our servers or networks.
ACCOUNT REGISTRATION
- In order to access certain services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password.
- You agree to provide accurate, current and complete information during the registration process and to keep such information current.
INTELLECTUAL PROPERTY
All content present on our website and services, including but not limited to text, graphics, logos, images, and software, is the property of the Company and is protected by intellectual property laws.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use of or inability to use our services.
CANCELLATION OF SERVICES
- You may cancel our services at any time by sending a written request to info.office@digitaledge-it.com.
- The cancellation process will be initiated within 5 working days of receipt of your request.
- For prepaid services, cancellation will take effect at the end of the current billing period. No refunds will be made for unused time in the current billing period.
- For monthly payment services, the cancellation will take effect at the end of the current month.
- There are no cancellation costs, unless otherwise specified in a specific service contract.
- The Company reserves the right to cancel or suspend services at any time for violation of these Terms or for non-payment.
REFUND POLICY AND CHARGEBACKS
- Refund requests must be made in writing to info.office@digitaledge-it.com within 30 days of purchase.
- Refunds will be processed on a case-by-case basis and may be subject to a processing fee of 5% of the amount refunded.
- In the event of a chargeback:
- We will contact you within 3 business days to resolve the issue.
- b) If the chargeback is the result of fraud or error, we will work with you to resolve it at no additional cost.
- c) If the chargeback is unjustified, we reserve the right to dispute it and may suspend or terminate your services.
- d) Repeated or unjustified chargebacks may result in the termination of your account and the No Use of Our Services in the Future.
- Refund Limit: The maximum refund amount for cancelled or unused services will be up to 50% of the total price paid for the service, and will be processed under the conditions described in this refund policy section. This cap applies to all services, unless otherwise specified in a specific agreement.
INDEMNITY
You agree to defend, indemnify, and hold harmless Digital Edge IT, its affiliates, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including, but not limited to, attorneys’ fees) arising out of:
- Your use of and access to our services;
- Your violation of any of these Terms;
- Your violation of any third party rights, including, but not limited to, intellectual property rights or privacy rights;
- Any claim that its content has caused damage to a third party.
This defense and indemnification will survive these Terms and your use of our services.
ANTI-MONEY LAUNDERING
Digital Edge IT is committed to the prevention of money laundering and terrorist financing. We reserve the right to:
- Verify the identity of our customers;
- Monitor suspicious transactions;
- Report suspicious activity to the competent authorities;
- Refuse or suspend services if we suspect money laundering activities.
By using our services, you agree to cooperate with any anti-money laundering-related investigations and provide such information as we reasonably request in order to comply with our legal obligations.
USE OF THE WEBSITE BY MINORS
- Our services are not directed to persons under the age of 18. If you are under the age of 18, you may not use our services or provide us with any personal information.
- If we learn that we have collected personal information from a child under the age of 18 without verifiable parental consent, we will take steps to delete that information from our servers.
- If you are a parent or guardian and believe that your child under the age of 18 has provided us with personal information, please contact us so that we can take the necessary steps.
GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of Cambodia. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts of Phnom Penh, Cambodia.
